What Elizabeth said. I would never use a primary navigation device that required Javascript (or Java or Shockwave, etc.) as long as:

a) so many people keep that "feature" turned off for security and/or crashing reasons

b) so many browser versions in the world do not (fully) support it

UNLESS I could dictate the platform my users would access the site with. Even then, if the site is planned to be long-lived, chances are things would change over time that would cause a structural redesign of the site, because of the use of that technology. 

Even browser-detection with Javascript (e.g., for forms/noforms redirects) fails miserably much of the time. Javascript is the best way to prevent ~ 50% of your potential audience from using your Web site.
