There are two independent issues:

#1: The labeling of the checkbox. It should be a positive statement as
Nielsen says. Using negative statements is confusing for the user,
specially when combined, i.e. "not (don't ckeck spelling) and not
(don't capitalize text)."
It should be exprese in the terms users refer to the subject, stripped
of  prepended negation particles.

#2: The default: it can be true or false. This depends on general user
expectacions, business rules, vested interests ("please send me email
on your products" checked by default), etc.

Issue #2 is unrelated to issue #1.
